Halle Berry's nanny restraining order against Gabriel Aubry denied

Halle Berry's nanny, Alliance Kamdem, was denied a restraining order request on January 24 against Gabriel Aubry, the father of Berry's daughter Nahla, OnTheRedCarpet.com has confirmed.

The Los Angeles Police Department is in the midst of a criminal battery and child endangerment investigation with the male model. Aubry is accused of Kamdem while Nahla was in her arms on January 18. He has not commented.

Kamdem told investigators she had gone to pick Nahla up from school but was told that she never showed up. The nanny then went to Aubry's home where she picked up his daughter and asked why he hadn't taken her. It was then that Aubry went on a racist rant, screaming and cursing at Kamdem, before finally pushing her with Nahla in her arms.

According to Kamdem's request, she is required by a court order to be in each of the parent's homes with Nahla from 12:30 p.m. until the girl is put to bed for the night. She is also required to perform the transition for each parent's home.

Kamdem claimed that within a week of the time she started working as Nahla's nanny, Aubry became abusive and claimed she was a spy. He reportedly told Kamdem: "I don't need you here, I don't want you here."

She also claimed Aubry was violent toward her by the second week. "I was at the door to his apartment, putting my shoes on, and he violently pushed me out the door before I could even finish with my shoes. He then slammed the door on my face," Kamdem wrote in her request. She also wrote she was "psychologically traumatized" from the confrontation.

A judge denied her request for the restraining order and said it is "insufficient and speculative." The judge added that concerns should be resolved in family court.

On Wednesday, January 25, Los Angeles Department of Children and Family Services representatives spoke with Berry regarding Kamdem's accusations, OnTheRedCarpet.com has learned. During investigations of abuse or neglect, such officials typically speak to both parents.

Berry and Aubry have been involved in a heated custody battle over their 3-year-old daughter for months and Berry entered a Los Angeles courtroom on Tuesday morning on crutches for an emergency hearing where she planned to ask a judge to prohibit Aubry from having contact with Nahla until after his child endangerment investigation is resolved.

On Tuesday, the judge decided to keep all the orders in place and not change the current custody agreement because he was not the regular judge assigned to the case. The regular judge returns to court on Monday, when both parties will return to discuss Berry's request. Berry wants Aubry to be prohibited from having any contact with Nahla until the police's criminal investigation of Kamdem's case is completed.
