Halle Berry's ex Gabriel Aubry injured in fight with fiance Olivier Martinez
Halle Berry's ex-boyfriend Gabriel Aubry was hospitalized for injuries sustained during a violent confrontation with her fiance, Olivier Martinez, near the Oscar-winning actress' Beverly Hills home on Thursday - Thanksgiving day.
Los Angeles Police Department sources told KABC Television, OTRC.com's parent company that a citizen's arrest of Aubry, who is suspected to have started the fight, was made but that officers have not yet booked anyone into custody.UPDATE at 2:45 p.m. PT: Gabriel Aubry was released from a Beverly Hills hospital and is currently being taken to a police station, where he is expected to be formally booked. The fight occurred as Aubry was dropping Nahla, his and Berry's 4-year-old daughter, off at the actress' home to celebrate Thanksgiving, the Los Angeles Police Department told People magazine. The child did not witness the fight, a source close to the matter told KABC Television, adding that Berry saw the beginning of it and rushed to call 911, reporting an assault with a deadly weapon. It is unclear if any were found.
An ambulance was called to Berry's house around 10 a.m. that morning and one person was transported, a L.A. City Fire Department spokesperson said. Aubry was admitted to a Beverly Hills hospital, the police sources said.
Berry, Aubry and Martinez have not commented. The news comes amid a custody battle between the actress and Aubry over their child. Two weeks ago, a Los Angeles denied Berry's request to move to France with her.
The police source said it appears Aubry started the fight on Thursday and that Martinez "apparently gave back more than Gabriel dished out." Aubry suffered fractured ribs and his face was bruised, a source close to the situation told KABC Television, adding that he had punched and pushed Martinez, who injured his hand and neck but appears to be okay.
Meanwhile, a Los Angeles judge has issued an Emergency Protective Order (EPO) against Aubry to protect Berry, their daughter and Martinez. It is valid until December 3 and dictates that Aubry must stay at least 100 yards away from the three.
Berry and Aubry, a model, dated for four years before splitting up in April 2010. Their relationship became contentious as they battled over custody issues, including Berry's busy filming schedule and her accusations that her daughter was "traumatized" after a visit with Aubry.
In January 2012, Berry's nanny, Alliance Kamdem, was denied a restraining order request against Aubry after he allegedly pushed her while she was carrying Nahla.
Berry and Martinez, an actor, became engaged earlier this year. They met on the set of the movie "Dark Tide" around the summer of 2010.
