Britney Spears slapped with $10M lawsuit over fragrance deal
Britney Spears and her father Jamie were recently slapped with a $10 million lawsuit from a marketing company that claims it was cheated out of royalties made off of the singer's fragrance, Radiance.
The two have not commented on the case.
Brand Sense Partners says that more than five years ago, it brokered a licensing deal for the singer with cosmestics manufacturer Elizabeth Arden, under which Brand Sense would be contractually entitled to a 35 percent commision on any Britney Spears-branded fragrances sold by the company.
Under the agreement, Brand Sense would receive all royalties from Elizabeth Arden, deduct its commission and then forward the sum to Spears, the lawsuit states.
"In or about early 2010, Britney contacted Elizabeth Arden, unbeknownst to Brand Sense, and instructed Elizabeth Arden to send all royalties directly to Britney. This was in breach of the parties' agreement," Brand Sense says.
Jamie Spears, the lawsuit states, had "complained that the commission was too high and said that Britney did not want to pay it." Brand Sense says it later agreed to his proposal to amend the deal so that Elizabeth Arden would forward Spears' and Brand Sense's share of the royalties separately.
However, the lawsuit states, Britney and Jamie Spears had at this time already entered into a new licensing deal with Elizabeth Arden and had kept Brand Sense in the dark about it for months.
Brand Sense is seeking more than $10 million and punitive damages, as well as a 35 percent commision on all lines of Spears' fragrances created by Elizabeth Arden.
Jamie Spears and an attorney have controlled the pop singer's financial affairs since 2008 as part of a court-ordered conservatorship, established after she was hospitalized for psychiatric observation.
In 2007, following months of partying, Spears underwent a rehab stint for substance abuse and famously shaved her own head at a salon (see video)
Spears has in recent months managed to rebuild her image. She recently released her seventh studio album, "Femme Fatale," and is preparing to go on tour.
